1. Introduction

Welcome to FunDad ("we," "our," or "us"), an application operated by Roasters Technologies SRL. By downloading, accessing, or using the FunDad mobile application (the "App"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

FunDad is an AI-powered activity planner that uses computer vision technology to identify objects in a user’s environment and suggest age-appropriate games and activities for children and parents.

3. Important Safety & AI Disclaimer

You acknowledge that FunDad provides suggestions for physical activities and games using Artificial Intelligence.

AI Disclaimer: Activity suggestions are AI-generated and may contain errors. Please review all activities for safety and suitability before playing. FunDad is not liable for any actions taken based on these suggestions.

Assumption of Risk: Participation in any activity suggested by the App is voluntary. You agree that you are solely responsible for ensuring the safety of the environment and the suitability of the activity for your child’s age, skill level, and physical condition.

Supervision: Active adult supervision is required at all times during play.

Liability Release: To the fullest extent permitted by law, Roasters Technologies SRL shall not be liable for any injuries, damages, or losses (including property damage to furniture or household items) arising from the execution of games or activities suggested by the App.

4. User Accounts

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Privacy and Data Usage

Your use of the App is also governed by our Privacy Policy.

Camera & Image Processing: The App uses your device’s camera to scan your surroundings for the purpose of generating game ideas.

Volatile Memory: Images are processed in volatile memory for the sole purpose of activity generation and are immediately discarded. They are not stored or used to train the model.

6. Subscriptions and Payments

Apple App Store: If you purchase a subscription through the Apple App Store, the transaction is governed by Apple’s Media Services Terms and Conditions.

Renewals: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage your subscriptions in your Apple ID Account Settings.

Refunds: All refund requests must be directed to Apple Support.

7. Intellectual Property

All content, features, and functionality of the App (including but not limited to the "FunDad" name, logo, AI algorithms, and game database) are the exclusive property of Roasters Technologies SRL and are protected by copyright, trademark, and other intellectual property laws.

8. User Conduct

You agree not to:

• Use the App for any illegal purpose.
• Attempt to reverse engineer the AI or computer vision technology.
• Harass, abuse, or harm another person via the platform.

9. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Limitation of Liability

In no event shall Roasters Technologies SRL be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the App.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts located in Cluj-Napoca, Romania.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Continued use of the App constitutes acceptance of the new Terms.
